EULA - End User License Agreement

License Agreement for KJ Clipper Software:

NOTICE TO USER:
THIS IS A CONTRACT. BY USING THE SOFTWARE PROVIDED WITH THIS LICENSE (the “SOFTWARE”), YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
KJ Nova™, Inc. ("KJ Nova") hereby grants to you a non-exclusive, limited and nontransferable license to use the Software and any accompanying documentation ("Documentation") on the terms set forth:

Limited Trial:
You may use the Software for a one-time trial period of 21-days without charge. This period applies to individual users and as a user, you are entitled to one 21-day trial. After that period, you will either, (a) purchase the software for the current market price through an authorized outlet, or (b) cease using the software and remove or uninstall it from any computers on which it may be installed or stored. The 21-day period starts with the initial install of the Sofware and acceptance of this license agreement.

Upon full payment for the Software,
You may:
(i) use the Software on any single computer for internal use only and not for resale, lease or time-share purposes; and
(ii) make a copy of the Software for backup purposes, provided any copy contains all of the original Software's proprietary notices, and provided the backup copy is not in use at the same time as the production copy. The Software is in "use" when it is loaded into RAM, installed on a hard disk, or installed on another storage device.
You may not:
(i) modify, translate, reverse engineer, decompile, disassemble, create derivative works based on the Software, or Documentation; or attempt to increase the functionality of the Software in any manner;
(ii) copy the Software (except for backup purposes) or Documentation;
(iii) rent, lease, or otherwise transfer rights to the Software or Documentation.
SOFTWARE. If you receive your first copy of the Software electronically, and a second copy on media, the second copy may be used for backup purposes only. This license does not grant you any right to any enhancement or updates.

TITLE. Title, ownership, and intellectual property rights in and to the Software and Documentation shall remain with KJ Nova. The Software is protected by the copyright and other laws of the United States and international treaties.

LIMITED WARRANTY. For a period of thirty days from the date of shipment, KJ Nova will fix or replace all Software that does not materially conform to the documentation therefore. KJ Nova disclaims all other warranties, express or implied, including the implied warranties of merchantability, noninfringement and fitness for a particular purpose. KJ Nova does not warrant that the Software is error free, and KJ Nova's total liability for any cost, claim, loss or damage resulting from use of the Software is limited to the price paid by user for the Software causing the cost, claim, loss or damage. This shall be User's sole remedy and KJ Nova's sole liability for any malfunction of the Software.
